By accessing or using this site, you (the “Customer”) indicate your unconditional acceptance of these Terms of use (the “Terms of Use”). We reserve the right, in our sole discretion, to update or revise these Terms of Use. Your continued use of the site following the posting of any changes to the Terms of Use constitutes acceptance of those changes. When you purchase items on our site you enter into a binding agreement which is governed by the Terms of Use.

To place an order with Della you are confirming that you are of the legal capacity to enter into a contract with Della (of the correct age, have authority to use the credit card etc.).

These Terms of Use shall prevail over any separate terms put forward by you. Any conditions that you submit, propose or stipulate in whatever form and at whatever time, whether in writing, by email or orally, are expressly waived and excluded. No other terms or changes to the Terms of Use shall be binding unless agreed in writing signed by us.

 

returns general policy:

If you are not 100% happy with your purchase, we will gladly accept your return and refund you within the Returns Policy period. In order for your return to be valid, we need to have received a tracking number with the original product in its original condition.

Try on your item to make sure you absolutely love it! If not, you can easily return it in three easy steps:

  • Step 1: Request a return by sending an email to returns@withlovedella.co.za stating your order number and the item you’d like to return, within the first 5 working days of receiving your goods.
  • Step 2: Return the parcel using your preferred shipment options noting that the parcel has to reach us within 5 working days of the email notification mentioned in step 1.
  • Step 3: Once your returned items reach us and have been inspected a refund will be processed within 5 working days.

Return Conditions

  • We do not accept returns on orders that do not comply with the “Returns General Policy” steps listed above.
  • The cost of returning the Item is for the customer’s account.
  • No refunds will be issued on shipping/courier fees
  • When paying via Credit Card we offer exchanges when possible or refund the card used to place the order.
  • When paying via EFT or Bank Transfer we can offer a full refund to your account.
  • For your protection, we recommend that you insure your return package against loss and damage and request a delivery confirmation.
  • We do not accept returns if the item is no longer in its original condition.
  • Della reserves the right to change the returns policy at any stage without warning. It is the customer’s responsibility to ensure that they are aware of the returns policy at checkout.

 

2. product sales and availability

All products displayed on our website are subject to availability and will be delivered only within the Republic of South Africa. All prices shown on our website are quoted in South African Rands and are valid and effective only in the Republic of South Africa. We reserve the right to discontinue or change the specifications of our products and services from time to time without notice. We will inform you as soon as possible if any products or services ordered by you are not available.

 

3. colours

We have made every effort to display as accurately as possible the colours of the products that appear on our website. However, as the actual colours you see will depend on the device that you use to access our website, we cannot warrant that your device’s display of any colour will be accurate.

 

4. pricing policy

You will be charged the prices as they are reflected on the website, subject to availability. Special promotions may be subject to certain conditions, including stock availability and limited offer stipulations. A delivery fee will be charged for each order placed.

 

5. methods of payment

Payment can be made in one of the following manners:
• Debit Card;
• Credit Card and cheque card
• Instant EFT

6. how to pay

Online Registration
When purchasing goods online you will be required to register with a site called Payfast, which site is used to process all online payments made to Della. When registering with Payfast, you will be required to provide certain information including personal details, payment card details and your delivery address. Our website will only require that you enter your delivery address.

Pay with Instant EFT
Instant EFT is a secure payment service that allows for electronic funds to be transferred directly into Della’s bank account using your bank’s internet banking functionality. Capitec, ABSA, First National Bank, Investec, Nedbank and Standard Bank are supported.

How it works:

  • Select Instant EFT as your payment option during checkout and click on the ‘Order & Pay Now’ button
  • You will be taken to the I-Pay page and you will select your bank
  • Login using your internet banking credentials
  • Select an account to pay from and enter a reference for your records
  • The automated process will navigate and populate the relevant fields on your behalf in the background
  • Your bank will send you an OTP (one-time password) or mobile authentication to your mobile phone to verify the payment
  • Enter your OTP or accept the authentication message
  • Payment is complete and your order is secured

 

Pay with a credit or debit card

  • Visa, Mastercard and American Express cards can be used to pay for your order.
  • Once you have selected to pay via credit or debit card, you will be requested to fill in your card details on our secure checkout. If you are using a credit or debit card for the first time, you will also be requested to verify your card using 3D Secure as an added security measure.
  • Della does not have access to any of your secure banking information.
  • If the payment was successful, customers will receive an email with an invoice containing an order number and order status. The status of your order will reflect as Payment Received.
  • Every precaution should be taken from the consumer’s side to ensure their details are kept safe. We don’t recommend shopping from an internet café or public computer.

 

7. confirmation of orders

Orders placed online constitute your offer to purchase subject to these Terms and Conditions. Your offer is deemed to have been accepted by us when you receive our confirmation of your order. Failure by us to formally confirm or notify acceptance shall not affect the validity of the sale or the enforceability thereof.

 

8. orders and delivery

Della is based in Johannesburg and offers a standard courier delivery service to everywhere in South Africa. R60 to inland areas and R120 to coastal areas.
Main centre deliveries are usually made within 1-3 working days of the order being shipped (Bloemfontein, Cape Town, Durban, Johannesburg, George, Pretoria, Port Elizabeth, East London, Pietermaritzburg, Polokwane and Kimberley). Regional or outlying areas, the deliveries will take place within 5 working days of the order being shipped.

NOTE: We do not ship internationally.

PLEASE NOTE: To assist our courier, please include the recipient’s cell phone number to ensure that orders are delivered on the first attempt. We also cannot guarantee prompt delivery at a specific time on a certain date as we rely on 3rd Party couriers for our deliveries.

We shall aim to let you know if we expect that we are unable to meet our estimated delivery date, but, to the extent permitted by law, we shall not be liable to you for any losses, liabilities, costs, damages, charges or expenses arising out of late delivery.

On delivery of the Product, you may be required to sign for the delivery. You agree to inspect the Product for any obvious faults, defects or damage before you sign for the delivery. You must keep the receipt of the delivered product if you want to discuss the item further with us.

Please note that it might not be possible for us to deliver to some locations. If this is the case, we will inform you using the contact details that you provide to us when you make your order and arrange for cancellation of the Order or delivery to an alternative delivery address.

All risk and ownership of the Product shall pass onto you on delivery of the product. If you are not available to take delivery at the address you supplied (or delivery has not been able to take place by your fault) all risk and ownership will be passed to you from the time delivery was originally intended. From this point on Della is no longer liable for any loss or damage to the product.

Any damage incurred when opening the product is your fault and Della will not be liable. Please take care when using sharp objects.

If you are not available to take delivery or collection, we may leave a card giving you instructions on either re-delivery or collection from the carrier. Costs for redelivery will be passed onto you.

At any stage during the delivery process, until you take delivery of the goods, Della may choose to cancel the order.

We do not warrant that products will suit your individual needs. We sell products without consideration for their end use.

For verification purposes, the person accepting delivery at the delivery address may be required to produce a form of identification. Any person other than yourself, who receives the products at the delivery address is presumed to be authorised to accept delivery on your behalf. Please arrange that you or your authorised representative is available to accept your purchases at the delivery address and that appropriate access will be made available. On delivery, we will require you or your authorised representative to sign and print your or their name on a duplicate copy of the delivery note, to confirm receipt. We have outsourced all delivery and collection arrangements. Accordingly, we cannot, to the extent permitted by law, be liable for any damage suffered or loss incurred by reason of any acts or omissions of the deliverer, its directors, employees, sub-contractors, agents, representatives and/or affiliates.

We deliver to the recipient’s physical address (specified in the delivery address area), throughout South Africa. The cost per delivery is R70(inland) and R120 (coastal) to a maximum of 5Kg’s. When an order is placed and the weight of which exceeds 5 Kg’s we will automatically contact you to discuss delivery costs and options.

Corporate orders will be looked at independently to offer the best cost price.

Delivery to hospitals, maternity wards, nursing homes, government buildings, etc. will be made to the relevant reception area.

 

9. refunds and returns policy

10. cancellation

Once the order has been dispatched, no cancellations will be accepted. As payments are processed through Payfast a 10% admin fee will be charged on any cancelled orders after payment is made.

If you cancel your payment, for any reason or if your payment card should cease to be valid, you will nevertheless be bound to pay the full admin fee on any cancellations.

 

11. risk and ownership

Risk in the products shall pass to you or your authorised representative on delivery. We will retain ownership of the products until full payment has been received.

Withlovedella.co.za, referred to below as Della, is an online retailer of consumer goods.

Della values our relationship with you and the other users of this website. We recognize that you may be concerned about our collection, use, and disclosure of your personally identifiable information that we may collect when you use the Web Site.
